Welcome to TPDev.io (referred to as “TPDev,” “we,” “us,” or “our”). By accessing or using this website, you agree to be bound by the following Terms and Conditions. If you do not agree with these terms, you are prohibited from use of our website and services.

  1. Use of the Website
    You may only use this website for lawful purposes and in accordance with these Terms. You agree not to use TPDev.io in a manner that could damage the website, disrupt its functionality, or interfere with the rights or access of other users.
  2. Intellectual Property
    All content, branding, graphics, layouts, digital products, designs, code, and materials featured on TPDev.io are the exclusive property of TPDev unless otherwise noted. Copying, reselling, distributing, modifying, or reproducing any site materials without written permission is prohibited.
  3. Project Ownership and Deliverables
    All work created by TPDev—including designs, development files, graphics, layouts, or digital assets—remains the property of TPDev until full payment has been made. Upon final payment, ownership transfers to the client as outlined in the project agreement or invoice. TPDev may retain the right to display completed work in portfolios or promotional materials unless otherwise agreed in writing.
  4. Payment Terms
    All web design projects follow a two-payment structure:
  • An initial non-refundable security deposit to begin work
  • A final balance upon completion of the project

Work will be halted or terminated if payments are late or incomplete. Payments made toward work already performed are non-refundable unless stated otherwise in writing.

  1. Client Responsibilities and Project Deadlines
    Clients are responsible for providing all required content, images, logins, direction, and information necessary for project completion. If TPDev requests information and the client does not provide it within seven (7) days, the project will be automatically terminated on the seventh day without refund. Work completed up to that date will not be delivered or published until the client satisfies payment obligations and a new timeline is agreed upon.
  2. Website Maintenance and Ongoing Services
    Clients may subscribe to maintenance or support plans. Terms including coverage, service limits, and response times will be documented separately. Maintenance plans do not include major redesigns, new development features, or scope expansion unless explicitly stated. Failure to maintain payments may result in suspension or cancellation of ongoing services.
  3. Third-Party Tools and Integrations
    TPDev may use third-party hosting, plugins, APIs, platforms, or software to deliver website functionality. TPDev is not responsible for downtime, updates, performance limitations, compatibility problems, or technical failures caused by third-party providers.
  4. Marketplace and Digital Products
    TPDev may offer templates, plugins, design files, or downloadable digital products. Unless otherwise stated:
  • All digital product sales are final
  • Licenses apply only to the original purchaser
  • Products may not be resold, shared, or redistributed
  • Digital products are provided “as-is” without guarantee of compatibility with every platform, theme, host, or setup
  1. Warranties and Disclaimers
    TPDev.io is provided on an “as-is,” “as-available” basis. We do not guarantee that the website or services will be uninterrupted, error-free, fully secure, or meet all user expectations. TPDev disclaims responsibility for losses stemming from user error, hosting problems, third-party failures, or factors beyond our control.
  2. Limitation of Liability
    To the fullest extent permitted by Georgia state and U.S. law, TPDev is not liable for direct, indirect, incidental, consequential, or punitive damages arising from use of the website or services. This includes, but is not limited to, loss of revenue, data loss, business interruptions, security breaches, hosting issues, or unauthorized account access.
  3. User Accounts (If Applicable)
    If the site offers user accounts, users are responsible for maintaining confidentiality of login details and all actions performed under their account. TPDev may suspend or terminate accounts suspected of misuse or violations of these Terms.
  4. User Content
    Users who submit files, text, images, instructions, or other content warrant that they own the rights to such content. By providing content, users grant TPDev the rights necessary to use, store, process, or display the materials in order to perform contracted services. Illegal or harmful content may be removed at TPDev’s discretion.
  5. Privacy
    Your use of this website is also governed by our Privacy Policy and Cookie Policy. By continuing to use the site, you agree to the data handling practices described in those documents.
  6. Modifications to Services or Website
    TPDev may change, update, add, or remove site content or services at any time without notice. We may also update these Terms occasionally. Continued use of the website after changes are posted indicates acceptance of the revised Terms.
  7. Cancellation and Refunds
    Project cancellations must be submitted in writing. Refund eligibility depends on the amount of work completed at the time of cancellation. Planning, communications, or development work already completed is non-refundable. Subscription services already billed are non-refundable unless required by law.
  8. Governing Law
    These Terms and Conditions are governed by the laws of the State of Georgia, USA. Any disputes shall be resolved through the appropriate state or federal courts located in Georgia.
  9. Subscription Billing Terms
    Some TPDev services may be billed on a recurring subscription basis. By subscribing, you authorize TPDev to automatically charge your payment method on file at your agreed billing interval.

Subscription policies include:

  • All fees must be paid in advance
  • Failed payments may lead to service suspension
  • Pricing may change with notice, and continued use indicates agreement
  • Cancellations must be submitted in writing before the next billing cycle
  • No refunds are provided for previously billed periods unless required by law

Service availability may rely on third-party systems, and TPDev is not responsible for outages, failures, or issues caused externally.

  1. Indemnification
    You agree to fully indemnify, defend, and hold harmless TPDev, its owners, employees, contractors, agents, and affiliates from any claims, damages, losses, liabilities, demands, or expenses (including attorneys’ fees) arising from:
  • Your use or misuse of TPDev.io or provided services
  • Your breach of these Terms
  • Your violation of laws, regulations, or third-party rights
  • Content or materials you submit or require TPDev to use
  • Any damages caused by misuse of delivered work, designs, code, or services

This indemnification applies even if TPDev is partially responsible for the alleged harm, except where not permitted by law. TPDev may assume sole control over legal defense at your expense if necessary.
